1. Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Pace Wireless LLC ("Pace Wireless", "we", "us", or "our"), governing your access to and use of the HaLow Portal (halow.pacewirelessllc.com), cloud telemetry APIs, MQTT endpoints, notification services, firmware builds, device management utilities, and desktop flasher applications (including HaLow Flasher) (collectively, the "Services").
BY CREATING AN ACCOUNT, ACCESSING THE PORTAL, PROVISIONING OR FLASHING HARDWARE WITH OUR PLATFORM, CONNECTING A COMPATIBLE WI-FI HALOW (IEEE 802.11ah) DEVICE, OR USING ANY PORTION OF THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.
Use of the Services is also subject to our Privacy Policy, including Google Analytics measurement of landing-page and dashboard usage.
2. Accounts, Authentication & Auth Key Security
To access protected platform features and register sensor or actuator hardware, you must register for an account. You agree to provide accurate information, maintain password confidentiality, keep your Auth Key secure, and be solely responsible for all activities and device commands issued under your account. Notify Pace Wireless LLC immediately upon any suspected breach.
3. Hardware, Firmware Flashing & Flasher Disclaimers
Pace Wireless LLC provides downloadable firmware images, reference applications, and flashing utilities (including the HaLow Flasher desktop application) to configure compatible development boards.
CRITICAL HARDWARE DISCLAIMER — ASSUMPTION OF RISK
Flashing firmware involves low-level serial (UART/USB) communications, bootloader manipulation, and memory writes. Flashing firmware carries inherent operational risks including device bricking, memory corruption, electrical failure, or hardware damage. PACE WIRELESS LLC IS NOT LIABLE FOR BRICKED OR DAMAGED HARDWARE. YOU EXECUTE ALL FLASHING ENTIRELY AT YOUR OWN RISK.
4. Controllable Devices, Actuators & Remote Commands
Certain hardware configurations are controllable (power outlets, relays, smart locks, gate controllers) and accept remote cloud-to-device commands. You are solely responsible for physical safety and ensuring remote actuation does not cause fire, injury, or property damage. Public network and wireless command latency may occur; do not rely on remote commands for emergency operations. Physical equipment must include manual safety stops and physical interlocks.
5. No Critical Life Safety or High-Risk Facility Use
THE SERVICES AND FIRMWARE ARE NOT DESIGNED OR CERTIFIED FOR HIGH-RISK OR LIFE-SAFETY APPLICATIONS. You shall not use the Services in connection with medical/life-support devices, emergency 911 dispatch, nuclear or chemical facilities, aviation, or any system where service failure could lead to death, injury, or catastrophic damage.
6. Wireless Radio Propagation & Telemetry Accuracy
Wi-Fi HaLow (IEEE 802.11ah) sub-GHz RF performance, range, RSSI, SNR, and data integrity are subject to physical obstacles, terrain, antenna placement, and interference. Telemetry is provided on an "as is" basis without guarantee of continuous or error-free transmission. Telemetry retention follows our rolling 30-day downsampled cloud storage policy.
7. Acceptable Use Policy
You agree not to reverse engineer backend services, flood or DoS API endpoints or MQTT brokers, bypass account authorization, inject spoofed telemetry, or transmit malicious code through the platform.
8. Intellectual Property
All software, portals, UI designs, APIs, logos, and firmware frameworks are the exclusive property of Pace Wireless LLC and protected by applicable copyright, trademark, and trade secret laws.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACE WIRELESS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR PROPERTY DAMAGES. TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF FEES PAID BY YOU IN THE PRECEDING 12 MONTHS OR $100.00 USD.
11. Indemnification
You agree to indemnify and hold harmless Pace Wireless LLC, its officers, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the Services, hardware deployments, or violation of these Terms.
12. Governing Law & Contact
These Terms are governed by the laws of the United States. For inquiries, contact Pace Wireless LLC at support@pacewirelessllc.com.
1. Introduction & Overview
Pace Wireless LLC respects your privacy and is committed to protecting the personal information and device telemetry processed through our Wi-Fi HaLow developer platform, portal, cloud APIs, and utilities.
2. Information We Collect
- Account Credentials: Email address, cryptographically hashed passwords, and provisioning Auth Keys.
- Hardware & Telemetry Data: Device identifiers, platform models, firmware versions, battery voltages, sensor telemetry (temperature, humidity, pressure, motion, light, particle AQI, radar, gate angle, water state), and RF radio metrics (RSSI, SNR, MCS).
- System Logs, Push Subscriptions & Product Analytics: Standard API request logs, IP addresses, browser push subscription endpoints when enabled, and Google Analytics 4 usage events for the landing page and dashboard.
3. How We Use Collected Information
We process collected data exclusively to operate the dashboard, route telemetry, execute remote commands, deliver requested push notifications, provide firmware updates, and maintain platform security.
NO SELLING OR MONETIZATION OF YOUR DATA
Pace Wireless LLC does NOT sell, rent, monetize, or trade your personal information, email addresses, or device telemetry to third-party data brokers or advertising networks under any circumstances.
4. Data Storage, Security & Retention
All transmissions use Transport Layer Security (TLS 1.3 / HTTPS / MQTTS). Authenticated telemetry samples are stored in PostgreSQL schemas strictly scoped by account owner and device ID. Trend history is retained for a rolling 30-day period with database downsampling.
5. Third-Party Service Providers
We work with essential cloud infrastructure providers (secure database hosting, transactional email delivery, browser push gateways) and Google Analytics 4 for product measurement. We do not enable Google advertising features, Google Signals, or ad pixels.
6. Cookies, Local Storage & Google Analytics
We use browser localStorage for operational session management (halow_jwt, halow_user, halow_selected_device, halow_last_email). Google Analytics 4 sets first-party _ga cookies to measure landing-page and dashboard usage. We do not send email addresses, Auth Keys, or device identifiers to Analytics. Browsers that send Global Privacy Control (GPC) do not grant analytics storage. See the full Privacy Policy for details.
7. User Rights & Account Controls
You can regenerate your Auth Key, rename/reorder/delete registered devices, adjust notification preferences, or request full account deletion by contacting support@pacewirelessllc.com.
